The penalties for a hit and run depend on the circumstances surrounding the accident:

- If an accident resulted in personal injury, a driver who leaves the scene of an accident without lending assistance could face Class 4 felony punishable by one to three years in jail, a maximum fine of $25,000, and revocation of driver’s license. In addition, failure to report the accident to law enforcement is a Class 2 felony punishable by three to seven years in prison, a maximum fine of $25,000, and license revocation.
- If a hit and run accident results in death, the responsible driver is guilty of a Class 4 felony along with a Class 1 felony for leaving the accident scene, which carries with it four to 15 years in prison, a maximum fine of $25,000, and license revocation.
Illinois law requires that a written report be filed if an accident results in death, injury, or property damage of more then $1,500. The form needs to be filed online or via mail within 10 days of the accident, and the failure to do so could result in a driver’s license suspension.
